Motor Vehicles, Titling and Registration - As enacted, exempts certain active, volunteer firefighters and rescue squad members from payment of the regular registration fee at the time of renewal for license plate issued to the volunteer firefighter or rescue squad member; authorizes a county legislative body to waive the motor vehicle tax for motor vehicles receiving the exemption from the registration fee, if the waiver is approved in the same manner as the adoption of the motor vehicle tax. - Amends TCA Title 55, Chapter 4.

    Bill Summary

    Present law authorizes the issuance of special license plates for certain firefighters and emergency personnel. This bill exempts from paying the annual renewal fee the following who have such a special license plate:

    (1) Any active, volunteer firefighter, upon the certification or sworn statement from the chief of the fire department to which the person is attached confirming the person is an active, volunteer firefighter; and
    (2) Any active, volunteer member of a local rescue squad, upon the certification or sworn statement from the captain of the local rescue squad to which the person is attached confirming the person is an active, volunteer member.

    ON APRIL 5, 2018, THE SENATE ADOPTED AMENDMENT #2 AND PASSED SENATE BILL 270, AS AMENDED.

    AMENDMENT #2 requires that the firefighter or emergency personnel have at least one year of experience in order for this bill to apply to such person and specifies that this bill applies for only one plate. This amendment also changes this bill's effective date from upon becoming law to July 1, 2018.

    ON APRIL 16, 2018, THE HOUSE SUBSTITUTED SENATE BILL 270 FOR HOUSE BILL 268, ADOPTED AMENDMENTS #2 AND #3, AND PASSED SENATE BILL 270, AS AMENDED.

    AMENDMENT #2 incorporates the changes described in the Summary for Senate Amendment #2 and changes this bill's effective date from July 1, 2018, to upon becoming a law.

    AMENDMENT #3 adds authorization for a county legislative body to waive the motor vehicle tax for motor vehicles receiving an exemption under this bill from the registration fee, if the waiver is approved in the same manner as the adoption of the motor vehicle tax under present law. Under present law, the motor vehicle tax has to be approved by a two-thirds vote of the county legislative body at two consecutive, regularly scheduled meetings or by a majority of the number of qualified voters of the county voting in an election on the question of whether or not the tax should be levied.
