Taxes, Exemption and Credits - As enacted, creates exemptions from sales tax, registration fee, and motor vehicle privilege tax, for any motor vehicle sold to a veteran or service member who has a service-connected disability and who is eligible for a United States department of veterans affairs automobile grant under the Disabled Veterans' and Servicemen's Automobile Assistance Act of 1970; limits sales and use tax exemption to portion of price that is in excess of the amount of the grant received. - Amends TCA Section 5-8-102; Title 55, Chapter 4 and Title 67, Chapter 6.

    Bill Summary

    This bill exempts a new or used motor vehicle that is sold, given, or donated to a veteran or active-duty service member of the armed services from any applicable sales and use tax if:

    (1) The veteran or service member has a service-connected disability;
    (2) The veteran or service member receives a grant from the United States department of veterans affairs; and
    (3) The grant is used to provide or assist in providing the vehicle to the veteran or service member.

    This bill also exempts a motor vehicle sold, given, or donated to a veteran or active-duty service member who meets criteria (1)-(3) above from the motor vehicle privilege tax, the regular motor vehicle registration fee, and any fee for military cultural plates.

    This bill applies to motor vehicles sold, given, or donated to a veteran or active-duty service member on or after the effective date of this bill.

    ON FEBRUARY 5, 2018, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 15, AS AMENDED.

    AMENDMENT #1 limits the application this bill's sales and use tax exemption for motor vehicles sold or given to veterans and active duty military members who have a service-connected disability to the portion of the price of the vehicle that is in excess of the amount of the grant that the veteran or active duty military member receives from the department of veterans affairs to provide or assist in providing the vehicle.
